Premier Lavatory, LLC – Restroom Trailer Rental Agreement

This Restroom Trailer Rental Agreement ("Agreement") is entered into between Premier Lavatory, LLC, a Michigan limited-liability company ("Company"), and the undersigned customer identified below ("Customer"). Customer represents that the person signing on its behalf has full authority to bind any named organization.

Definitions & Parties
Company. Premier Lavatory, LLC, the party providing the Equipment.
Customer. The individual or entity renting the Equipment.
Equipment. The restroom trailer and all accessories, steps, ramps, cords, hoses, keys, and related items provided by Company.
Rental Period. The period beginning at delivery and ending at pickup.

Total Price. The Total Rental Price equals the Subtotal above. An itemised quote may be attached or incorporated by reference.

Booking Deposit. Customer shall pay twenty-five percent (25%) of the Total Price upon signing to secure the reservation ("Deposit"). No reservation is held until Deposit is received.

Balance Due. The remaining seventy-five percent (75%) is due fourteen (14) days before the earliest Event Date.

Automatic Cancellation. If the balance is not received by the due date, Company may cancel the reservation, retain the Deposit, and reopen the Equipment’s availability.

Cancellation & Refund Policy
Written cancellation notices are effective when received by Company.

Notice Period
Refund / Transfer
91 days or more – 100% of Deposit refunded (minus card fees)
61–90 days – 50% of Deposit forfeited; 25% transferable to a new date within one (1) year
31–60 days – 75% of Deposit forfeited; 25% transferable to a new date within one (1) year
1–30 days – No refund; 25% transferable to a new date within one (1) year

Customer remains liable for any unpaid balance if cancellation occurs after the balance-due date.

Security / Damage Deposit

Refundable Deposit. Prior to delivery, Customer shall authorise or pay a $300.00 refundable security deposit ("Security Deposit").

Deductions. Company may deduct from the Security Deposit any costs for loss, damage, repair, replacement, excessive cleaning, missing accessories, late pickup caused by Customer, or amounts otherwise owed under this Agreement. Any balance will be refunded within ten (10) business days after inspection.

Site & Utilities (Customer Responsibilities)

Power & Water. Customer shall provide:
1. Electrical: One 110–120 V, 20-amp grounded outlet within fifty (50) feet of trailer placement.
2. Water: One standard ¾-inch garden-hose spigot within fifty (50) feet.

Placement Area. Customer shall furnish a flat, level surface with at least twelve (12) feet of vertical clearance, fifteen (15) feet of width, and thirty (30) feet of total area for delivery, set-up, and pickup. Customer warrants safe, unobstructed access for Company’s tow vehicle.

Ground Damage. Company is not responsible for any damage to grass, concrete, asphalt, landscaping, or underground utilities caused by the trailer’s stabilisers, steps, or normal use.

Use & Care of Equipment

Prohibited Actions. Customer shall not move the Equipment once placed, allow smoking or open flames inside, dispose of anything other than human waste and toilet paper, or attach objects to the trailer without Company’s consent.

Basic Tidiness. Customer shall maintain reasonable cleanliness during the Rental Period. Company will perform standard post-event cleaning; costs for extraordinary cleaning or bio-hazard remediation may be deducted from the Security Deposit or billed separately.

Risk, Insurance & Liability

Risk of Loss. Customer assumes all risk of loss or damage to the Equipment (ordinary wear excepted) from delivery until pickup.

Insurance Recommendation. Company strongly recommends that Customer obtain event or general-liability insurance covering the Equipment and any bodily injury or property damage occurring during the Rental Period. Proof of insurance is not required but is advisable.

Indemnity. Customer shall indemnify, defend, and hold harmless Company, its owners, employees, and agents from all claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to Customer’s use of the Equipment or the event for which it is rented, except to the extent caused by Company’s gross negligence or wilful misconduct.

Accident Waiver. Customer acknowledges that restroom trailers involve steps, handrails, and electrical connections. Customer shall place the trailer in a safe location, ensure adequate lighting, and monitor guest use. Company shall not be responsible for any slip, trip, fall, or other personal injury occurring in or around the trailer unless caused solely by Company’s gross negligence or wilful misconduct.

Liability Cap. Company’s total liability under this Agreement shall not exceed amounts actually paid by Customer. Company shall not be liable for any indirect, incidental, or consequential damages, including lost profits or event disruption costs.

Force Majeure
Neither party shall be liable for delay or failure to perform caused by events beyond its reasonable control, including acts of God, severe weather, government orders, labour disputes, or utility failure. In such event, unused fees will be refunded or, by mutual agreement, the rental rescheduled.

Governing Law & Venue
This Agreement is governed by the laws of the State of Michigan. The parties consent to the exclusive jurisdiction of the state or federal courts located in Wayne County, Michigan for any dispute arising under this Agreement.

Miscellaneous

Entire Agreement. This writing constitutes the entire agreement and supersedes all prior discussions. Any amendment must be in writing and signed by both parties.

Severability. If any provision is held unenforceable, the remaining provisions remain in full force.

No Waiver. Failure to enforce any term shall not be a waiver of that term or any other term.

Assignment. Customer may not assign or sub-rent the Equipment without Company’s written consent.

Attorneys’ Fees. Customer shall pay Company’s reasonable attorneys’ fees and collection costs incurred in enforcing this Agreement.

No Warranties. Except as expressly stated, Company makes no warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Electronic Acceptance
This Agreement may be executed electronically. Typing a name, clicking an “I Agree” button, or paying the Booking Deposit constitutes Customer’s electronic signature under the Michigan Uniform Electronic Transactions Act.
